Transfers

Our clients value our Conveyancers’ hands-on approach throughout the transfer process as they are directly contactable and involved in all transactions.  In striving for a seamless transfer, we update parties regularly and expedite the transfer process.  We attend to transfers in all 9 provinces in South Africa.   We regularly attend to:

  • Conventional transfers
  • Auction transfers
  • Deceased estate transfers
  • Insolvent estate transfers
  • Assets for share transaction transfers in accordance with Section 47 of the Income Tax Act
  • Half share transfers pursuant to divorces;

Developments

We work closely with our development clients and their appointed professional team from the purchase of the land to the registration of the development and the transfer of all properties sold.  We have successfully registered multiple developments.  We work with our clients to obtain the necessary consents required by the Local Authorities, Bank Attorneys and the various Deeds Registries.  We regularly attend to:

  • Sectional title developments including conversion from commercial to residential
  • Commercial developments
  • Cluster developments
  • Creation of Home Owners Associations
  • Delegation of Body Corporate rights and responsibilities in terms of Section 6(4) of the Sectional Title Schemes Management Act to an Association created for this purpose
  • Preparation of Management and Conduct Rules

Other

Michelle’s opinion on property-related matters is sought out by clients and colleagues and she is regularly given watching briefs to oversee matters on behalf of clients.  Michelle attends to dispute resolution between parties where we are not the appointed attorneys.  This includes advising on sectional title matters where issues arise between members of Bodies Corporate and/or Trustees and/or Managing Agents.  We attend to the amendment of Management and Conduct Rules for existing sectional title schemes.
